Terms of Service

These Terms of Service ("Terms") govern your use of the website theholyamericanink.com and its consultation, booking, and related tools (the "Service"), operated by The Holy American Ink ("we," "us," "the studio"), located at 2455 E State Highway 121, Ste 123, Lewisville, TX 75056. By using the Service, you agree to these Terms.

1. Who Can Use This Service

Tattoo and piercing services are restricted to clients who are 18 years of age or older with valid government-issued ID, or accompanied by a parent/legal guardian where permitted under Texas law and studio policy. Submitting a consultation or booking request through the Service does not guarantee eligibility — final eligibility is confirmed in person by studio staff prior to any procedure.

2. Consultations & Bookings Are Requests, Not Confirmed Appointments

• Submitting the consultation form or the booking form sends a request to the studio. It is not a confirmed appointment until a studio representative contacts you directly (by phone, text, or Instagram) to confirm date, time, artist, and price.
• Estimated pricing shown on the site is approximate, based on general size/detail inputs, and subject to change once an artist reviews your specific design in person.
• A deposit may be required to hold a confirmed appointment slot. Deposit amounts, refundability, and no-show/cancellation policies are set and communicated by the studio at the time of booking confirmation, not on this website.

3. In-Person Consent Is Separate & Required

Nothing submitted through this website constitutes informed consent for a tattoo, piercing, or any procedure. Texas law and studio policy require a separate, physical or digital informed-consent and health-screening form to be completed in person, at the studio, before any procedure begins. The online forms on this site are for scheduling and communication purposes only.

4. Payments

Where online deposit/payment is enabled, transactions are processed by Square, Inc. Card details are handled entirely by Square's payment infrastructure; the studio never receives or stores your full card number. Cash, Zelle, and Cash App payments, where accepted, are handled manually by studio staff and are not processed through this website. All sales are subject to the studio's in-person refund and cancellation policy, communicated at time of booking.

5. Artist & Owner Accounts

Studio artists and the owner may be issued login credentials to manage their own portfolio content, respond to bookings, or use the SkyBrain AI writing assistant. Account holders are responsible for keeping their password confidential and for all activity under their account. Accounts are scoped by role (master / owner / artist) and may only access information appropriate to that role, as described in our Privacy Policy.

6. User-Submitted Content

By submitting a design idea, reference description, or any text through the consultation or booking forms, you confirm you have the right to share that content and grant the studio permission to use it internally to prepare and provide the requested tattoo/piercing service. Portfolio images uploaded by artists remain the property of the respective artist or studio, as agreed between artist and studio separately from these Terms.

7. Social Media Publishing

Where enabled, the studio's tools may allow an artist or the owner to publish approved portfolio content directly to the studio's connected Instagram and/or TikTok accounts. This feature only publishes content that a studio artist or owner explicitly selects and submits for publishing — it does not act autonomously and does not access or post anything beyond that specific action. Connected-account authorization can be revoked at any time from the relevant platform's own settings.

8. No Medical Advice

Nothing on this website, including any AI-assisted content, constitutes medical advice. Aftercare instructions, health screening, and any medical concerns should be discussed directly and in person with studio staff.

9. Disclaimer & Limitation of Liability

The Service is provided "as is." While we aim for accuracy, price estimates, availability information, and other content on the site may not always be current. To the fullest extent permitted by Texas law, The Holy American Ink is not liable for indirect, incidental, or consequential damages arising from use of the website itself (as distinct from the in-person tattoo/piercing service, which is governed by the separate in-person consent and liability waiver signed at the studio).

10. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Denton County, Texas.

11. Changes to These Terms

We may update these Terms as the Service evolves. The "Last Updated" date above reflects the most recent revision. Continued use of the Service after an update constitutes acceptance of the revised Terms.
